La iniciativa aprobada crea la “Comisión Bicameral Investigadora de Instrumentos Bancarios y Financieros Destinados a Facilitar la Evasión de Tributos y la Consecuente Salida de Divisas del País”, un título difícil para que entre en una tarjeta de presentación convencional.
El jefe del bloque kirchnerista, Miguel Pichetto, explicó que la comisión servirá para investigar “el modus operandi que hizo que en los últimos 30 años tengamos afuera del país más de 200 mil millones de dólares depositados en cuentas de bancos extranjeros”.
Por la UCR, Gerardo Morales defendió su proyecto paralelo para indagar también en el caso de Hotesur S.A., la empresa que administra el Hotel El Calafate propiedad de la presidenta Cristina Kirchner.
“Queremos investigar todo. No solo las 4.040 cuentas, sino el caso Hotesur”, indicó el jujeño.
En este sentido, denunció un intento por ocultar esa causa: “El Gobierno esconde el elefante con una manada de elefantes”, graficó.
Liliana Negre, del Peronismo Federal, alertó que “se crea esta comisión para reemplazar lo que no hicieron los funcionarios responsables” en esta materia.
El massista Roberto Basualdo sostuvo que “crear una comisión bicameral para ver si alguien tiene una cuenta afuera y llamarnos a nosotros a investigar, eso es tapar las cosas más importantes”.
“Si alguien tiene dinero no declarado en el exterior tendrá que ir a la Justicia, a rendir cuentas a la AFIP. Nosotros no tenemos nada que ver con eso. Pero sí podemos controlar los fondos del Estado”, opinó el sanjuanino.
La comisión estará compuesta por cinco diputados y cinco senadores y tendrá por objetivo informar al Poder Ejecutivo sobre las maniobras para evadir impuestos, denunciar los ilícitos ante la Justicia y promover las modificaciones legislativas que sean necesarias.
De esta manera, el Congreso buscará avanzar en paralelo con la denuncia judicial de la AFIP contra contribuyentes que abrieron cuentas bancarias Suiza sin declararlas ante el fisco.
Según la entidad recaudatoria, las cuentas habrían sido concretadas a través de una serie de plataformas ilegales montadas por el banco HSBC con el fin de facilitar la evasión en el pago de impuestos, en maniobras de al menos 3.000 millones de dólares.
De acuerdo al proyecto de ley, la comisión deberá publicar un informe completo del resultado de su trabajo, dentro de los 90 días contados a partir de su constitución, plazo que podrá ser prorrogado por única vez por otro igual.
Para ello tiene previsto la citación y audiencia de la entidad bancaria involucrada como instrumentadora de la operatoria y los titulares de las cuentas denunciadas por la AFIP, cuyo informe fue girado por dicha dependencia a las comisiones de Presupuesto y Hacienda del Senado y de la Cámara de Diputados.
En ningún caso podría interferir el secreto bancario, fiscal, bursátil y/o profesional, ni los compromisos legales o contractuales de confidencialidad en cuanto se trate de informes, testimonios, documentos o antecedentes de la materia objeto de la investigación.
